Acceptance and capacity<\/h2>\n    <p>Use of the site implies acceptance of these terms. You declare that you have sufficient legal capacity under Ecuadorian law to accept these terms and, where applicable, to request information or quotations on your own behalf or on behalf of the organization you represent. If you act on behalf of a company, you declare that you are duly authorized.<\/p>\n\n    <h2 id=\"t3\">3. Purpose of the site<\/h2>\n    <p>The purpose of the site is to provide information about technical training programs, certifications, industries served, clients and partnerships, and to facilitate information or contact requests. It does not in itself constitute a binding offer, an enrollment e-commerce store or a virtual learning campus, unless ITPMI expressly enables those features with additional conditions.<\/p>\n\n    <h2 id=\"t4\">4. Permitted use and prohibitions<\/h2>\n    <p>You agree to:<\/p>\n    <ul>\n      <li>Use the site lawfully, in good faith and in accordance with Ecuadorian regulations and these terms.<\/li>\n      <li>Not attempt to breach the security, operation or integrity of the site, its systems or those of third parties.<\/li>\n      <li>Not use the forms to send unlawful content, spam, malware, threats or false information.<\/li>\n      <li>Not perform scraping, mass extraction, mirroring or commercial reproduction of the catalog or content without ITPMI's written authorization.<\/li>\n      <li>Not impersonate others, interfere with other users or use the site in a way that causes reputational or economic harm to ITPMI.<\/li>\n      <li>Not circumvent technical security measures or access restricted areas (e.g. admin panels) without authorization.<\/li>\n    <\/ul>\n    <p>ITPMI may suspend or restrict access when there are reasonable signs of misuse, without prejudice to the relevant legal actions.<\/p>\n\n    <h2 id=\"t5\">5. Catalog and service information<\/h2>\n    <p>Content about courses, delivery modes, accreditations, dates, places, venues, durations and features is <strong>for information purposes only<\/strong>. Prices, availability, admission requirements, applicable certifications, instructors and commercial terms are confirmed when quoting or contracting with ITPMI. ITPMI may update, suspend or remove site content without prior notice when necessary for operational, commercial or accuracy reasons.<\/p>\n    <p>Third-party brands, seals or mentions (e.g. IADC, PetroSkills, Ministry of Labor or other accreditations) are used in accordance with current authorizations or relationships; they do not necessarily mean that the third party operates this site.<\/p>\n\n    <h2 id=\"t6\">6. Requests, WhatsApp and accuracy<\/h2>\n    <p>By submitting a form or starting a WhatsApp inquiry linked to the site, you declare that the data is accurate, up to date and that you are authorized to provide it. Requests may be handled by email, phone or WhatsApp Business and recorded in our CRM\/ERP (Odoo), as described in the <a href=\"https:\/\/itpmi.edu.ec\/en\/politicas-de-privacidad\/\">Privacy Policy<\/a>.<\/p>\n    <p>Submitting a request does not guarantee a place, date or specific price until there is express confirmation from ITPMI or an accepted contract\/quotation.<\/p>\n\n    <h2 id=\"t7\">7. Quotations, prices and contracting<\/h2>\n    <ul>\n      <li>Quotations, commercial proposals and training contracts are formalized outside mere access to the site (email, signed documents, purchase orders or other agreed means).<\/li>\n      <li>In B2B relationships (companies), the terms of the contract, purchase order or accepted quotation prevail.<\/li>\n      <li>In relationships with end consumers, where the Organic Consumer Protection Law applies, the consumer's inalienable rights will be respected.<\/li>\n      <li>Payments, invoicing, cancellations, rescheduling and certificate issuance are governed by the terms agreed in each contract and applicable tax regulations.<\/li>\n    <\/ul>\n\n    <h2 id=\"t8\">8. Future accounts and learning platforms<\/h2>\n    <p>In its current version, this site does not include student login or an LMS campus (e.g. Moodle). If ITPMI enables user accounts, virtual classrooms or other platforms in the future, it may require acceptance of additional specific terms of use, privacy and security. Unauthorized access to those platforms will be prohibited.<\/p>\n\n    <h2 id=\"t9\">9. Intellectual and industrial property<\/h2>\n    <p>The brands, logos, texts, photographs, designs, videos, code, catalog databases and other content on the site are the property of ITPMI or of third parties who have authorized their use. Reproduction, distribution, public communication, transformation or commercial exploitation without written authorization is prohibited, except for personal and informational use permitted by Ecuadorian intellectual property law.<\/p>\n\n    <h2 id=\"t10\">10. User content and image<\/h2>\n    <p>If you send comments, files or information through forms, you grant ITPMI a non-exclusive license to use that information solely to handle your request and manage the commercial relationship, without transferring ownership of your rights, and without prejudice to the LOPDP.<\/p>\n    <p>In in-person or virtual training sessions, ITPMI may request specific authorization to capture and use image or voice for institutional, training or attendance-evidence purposes, in accordance with personal data regulations and the terms of the contracted service.<\/p>\n\n    <h2 id=\"t11\">11. Links and social media<\/h2>\n    <p>The site may include links to third-party sites (social media, partners, maps, analytics providers, etc.). ITPMI does not control and is not responsible for the content, availability or privacy practices of those sites. The use of ITPMI's social media is also governed by the terms of each platform.<\/p>\n\n    <h2 id=\"t12\">12. Availability, warranties and force majeure<\/h2>\n    <p>ITPMI strives to keep the information up to date and the site available, but does not guarantee the absence of errors, interruptions, viruses or incompatibilities with all devices. The site is provided \"as is\" to the extent permitted by law. ITPMI will not be liable for failures arising from force majeure, acts of God, third-party failures (hosting, internet, WhatsApp, Google, Meta) or causes beyond its reasonable control.<\/p>\n\n    <h2 id=\"t13\">13. Limitation of liability<\/h2>\n    <p>To the maximum extent permitted by Ecuadorian law, ITPMI is not liable for indirect damages, loss of profits, loss of user data, or harm arising from the use of or inability to use the site, except in cases of willful misconduct or gross negligence. Nothing in these terms limits liabilities that the law declares inalienable.<\/p>\n\n    <h2 id=\"t14\">14. Consumer rights<\/h2>\n    <p>When you qualify as a consumer under the Organic Consumer Protection Law, these terms will be interpreted in accordance with that law. The consumer's inalienable rights prevail over any incompatible clause.<\/p>\n\n    <h2 id=\"t15\">15. Data protection<\/h2>\n    <p>The processing of personal data is governed by the <a href=\"https:\/\/itpmi.edu.ec\/en\/politicas-de-privacidad\/\">Privacy Policy<\/a>, the <a href=\"https:\/\/itpmi.edu.ec\/en\/politica-de-tratamiento-de-datos\/\">Personal Data Processing Policy<\/a> and the <a href=\"https:\/\/itpmi.edu.ec\/en\/politica-de-cookies\/\">Cookie Policy<\/a>, within the framework of Ecuador's LOPDP and article 66, paragraph 19, of the Constitution.<\/p>\n\n    <h2 id=\"t16\">16. Indemnity<\/h2>\n    <p>You agree to hold ITPMI harmless against third-party claims arising from misuse of the site, the submission of false or unauthorized information, or breach of these terms, to the extent permitted by law.<\/p>\n\n    <h2 id=\"t17\">17. Amendments<\/h2>\n    <p>ITPMI may amend these terms by publishing the updated version on this page with the date of last update. Continued use of the site after publication implies acceptance of the changes, to the extent permitted by law and without prejudice to inalienable rights.<\/p>\n\n    <h2 id=\"t18\">18. Governing law and jurisdiction<\/h2>\n    <p>These terms are governed by the laws of the Republic of Ecuador.
