Requests are channeled to <a href=\"mailto:contacto@itp.edu.ec\">contacto@itp.edu.ec<\/a>, without prejudice to the internal obligations of Management and the relevant areas (e.g. Human Resources, Sales, Operations).<\/p>\n\n    <h2 id=\"tr2\">2. Regulatory framework and definitions<\/h2>\n    <p>The following apply, among others: Constitution art. 66.19; LOPDP and its Regulations; resolutions and guidelines of the Superintendency of Personal Data Protection (SPDP); and, where applicable, the Law on Electronic Commerce and the Organic Consumer Protection Law.<\/p>\n    <p>For the purposes of this policy:<\/p>\n    <ul>\n      <li><strong>Owner:<\/strong> the natural person to whom the personal data refers.<\/li>\n      <li><strong>Data controller:<\/strong> INSTIPETROL C\u00eda. Ltda. (ITPMI), which decides on the purposes and means of processing.<\/li>\n      <li><strong>Processor:<\/strong> whoever processes data on behalf of the controller (e.g. Odoo, hosting, messaging or analytics providers).<\/li>\n      <li><strong>Processing:<\/strong> any operation on personal data (collection, storage, use, communication, deletion, etc.).<\/li>\n    <\/ul>\n\n    <h2 id=\"tr3\">3. Scope<\/h2>\n    <p>This policy applies to the processing of personal data carried out by ITPMI in Ecuador (and, where applicable, with international transfers) concerning data subjects who interact with ITPMI as prospects, clients, participants\/students, company representatives, instructors, suppliers, job candidates, website visitors or other groups described below.<\/p>\n\n    <h2 id=\"tr4\">4. Processing principles<\/h2>\n    <p>ITPMI processes personal data observing, in particular, the following LOPDP principles:<\/p>\n    <ul>\n      <li>Lawfulness, fairness and transparency.<\/li>\n      <li>Legitimate and limited purpose.<\/li>\n      <li>Data minimization and proportionality (only the necessary data).<\/li>\n      <li>Accuracy and keeping data up to date.<\/li>\n      <li>Retention limited to the necessary time.<\/li>\n      <li>Integrity, confidentiality and security.<\/li>\n      <li>Proactivity \/ demonstrated accountability, through policies, controls and contracts with processors.<\/li>\n    <\/ul>\n\n    <h2 id=\"tr5\">5. Processing inventory<\/h2>\n    <p>Without prejudice to additional specific processing disclosed in each channel, ITPMI carries out, among others, the following processing activities:<\/p>\n\n    <h3>5.1 Website, leads and sales support<\/h3>\n    <ul>\n      <li><strong>Data:<\/strong> name, email, phone, company, country, message, course of interest, technical browsing data and cookies (subject to consent).<\/li>\n      <li><strong>Purpose:<\/strong> answering inquiries, quoting, commercial follow-up, site improvement and campaign measurement.<\/li>\n      <li><strong>Channels:<\/strong> forms, WhatsApp Business, email, phone, Odoo CRM\/ERP, GA4, Meta Pixel.<\/li>\n    <\/ul>\n\n    <h3>5.2 Students, participants and corporate training<\/h3>\n    <ul>\n      <li><strong>Data:<\/strong> identification (names, ID\/passport when required), contact details, sponsoring company, position, attendance, assessments, grades, certificates issued, client billing data where applicable.<\/li>\n      <li><strong>Purpose:<\/strong> enrollment, delivery of the training service, attendance control, certificate issuance, post-course support and contractual\/legal compliance.<\/li>\n    <\/ul>\n\n    <h3>5.3 Corporate clients and their employees<\/h3>\n    <ul>\n      <li><strong>Data:<\/strong> data of representatives, purchasing\/training contacts, participant lists sent by the company.<\/li>\n      <li><strong>Purpose:<\/strong> performance of B2B contracts, logistics coordination and invoicing.<\/li>\n      <li><strong>Note:<\/strong> when a company sends data about its workers, that company must have a legal basis and internal authorizations; ITPMI processes that data as controller or in the role applicable to each operation, always for training\/contractual purposes.<\/li>\n    <\/ul>\n\n    <h3>5.4 Instructors and teaching staff<\/h3>\n    <ul>\n      <li><strong>Data:<\/strong> identification, contact details, r\u00e9sum\u00e9, accreditations, bank details for payments, teaching performance evaluations where they exist.<\/li>\n      <li><strong>Purpose:<\/strong> hiring, course coordination, payments and academic quality control.<\/li>\n    <\/ul>\n\n    <h3>5.5 Suppliers and partners<\/h3>\n    <ul>\n      <li><strong>Data:<\/strong> data of legal representatives and contacts, RUC, contractual and billing information.<\/li>\n      <li><strong>Purpose:<\/strong> purchasing management, partnerships, confidentiality and compliance.<\/li>\n    <\/ul>\n\n    <h3>5.6 Job candidates and human resources<\/h3>\n    <ul>\n      <li><strong>Data:<\/strong> r\u00e9sum\u00e9, identification, contact details and other data provided in selection processes.<\/li>\n      <li><strong>Purpose:<\/strong> evaluation of applications and, where applicable, formal employment in accordance with Ecuadorian labor regulations.<\/li>\n    <\/ul>\n\n    <h3>5.7 Image, voice and training evidence<\/h3>\n    <ul>\n      <li><strong>Data:<\/strong> photographs, videos or recordings of sessions, when captured.<\/li>\n      <li><strong>Purpose:<\/strong> evidence of attendance\/quality, institutional or training material, only with an adequate legal basis (consent or other authorization) and prior notice where applicable.<\/li>\n    <\/ul>\n\n    <h3>5.8 Security, access and technical records<\/h3>\n    <ul>\n      <li><strong>Data:<\/strong> access logs, IP addresses, incident records, physical or digital access control data where they exist.<\/li>\n      <li><strong>Purpose:<\/strong> information security, abuse prevention and defense of rights.<\/li>\n    <\/ul>\n\n    <h3>5.9 Certificates and validations<\/h3>\n    <ul>\n      <li><strong>Data:<\/strong> data needed to issue, archive and, where applicable, validate training certificates.<\/li>\n      <li><strong>Purpose:<\/strong> accreditation of the training delivered and handling of legitimate verification requests.<\/li>\n    <\/ul>\n\n    <h2 id=\"tr6\">6. Special categories of data<\/h2>\n    <p>ITPMI <strong>does not routinely request<\/strong> special categories of data (health, ideology, union membership, sex life, biometric data intended to uniquely identify a person, etc.).<\/p>\n    <p>If a processing activity requires them (e.g. minimal occupational health information in certain HSE courses, or data spontaneously included by the data subject in a message), ITPMI will:<\/p>\n    <ul>\n      <li>limit processing to what is strictly necessary;<\/li>\n      <li>apply reinforced legal bases when required by the LOPDP (e.g. explicit consent or another legal exception); and<\/li>\n      <li>reinforce confidentiality and restricted-access measures.<\/li>\n    <\/ul>\n\n    <h2 id=\"tr7\">7. Legal bases<\/h2>\n    <p>Depending on the case, ITPMI relies on one or more of the following LOPDP legal bases:<\/p>\n    <ul>\n      <li>Consent of the data subject.<\/li>\n      <li>Performance of a contract or pre-contractual measures at the data subject's request.<\/li>\n      <li>Compliance with a legal obligation.<\/li>\n      <li>Legitimate interest of ITPMI or a third party, weighed against the rights of the data subject (e.g. security, fraud prevention, basic service improvement).<\/li>\n      <li>Other bases provided by law where applicable.<\/li>\n    <\/ul>\n\n    <h2 id=\"tr8\">8. Processors, recipients and transfers<\/h2>\n    <p>The following may access personal data, to the extent necessary:<\/p>\n    <ul>\n      <li>Authorized ITPMI staff (sales, academic, administrative, finance, human resources and management areas).<\/li>\n      <li><strong>Odoo<\/strong> (CRM\/ERP) as data processor.<\/li>\n      <li><strong>Google<\/strong> (Analytics \/ GA4) and <strong>Meta<\/strong> (Pixel \/ WhatsApp), when the data subject consents or initiates the interaction.<\/li>\n      <li><strong>Hosting, development and technical support providers<\/strong>, including Alfa Business Planet Alfa BP S.A.S. (RUC 1793209203001) or other equivalent providers, under confidentiality and processing obligations where applicable.<\/li>\n      <li>Certification bodies, partners or corporate clients, when necessary to provide the service and there is a legal basis.<\/li>\n      <li>Competent authorities, upon a valid request.<\/li>\n    <\/ul>\n    <p>International transfers (e.g. cloud services in the United States or other countries) are carried out with adequate safeguards in accordance with the LOPDP and its Regulations (contractual clauses, technical and organizational measures, and data minimization).<\/p>\n\n    <h2 id=\"tr9\">9. Retention periods<\/h2>\n    <p>As a guideline (they may be adjusted according to legal obligations or contracts):<\/p>\n    <div class=\"legal-table-wrap\">\n      <table class=\"legal-table\">\n        <thead>\n          <tr><th>Type of data \/ processing<\/th><th>Indicative period<\/th><\/tr>\n        <\/thead>\n        <tbody>\n          <tr>\n            <td>Web inquiries \/ leads without contracting<\/td>\n            <td>Up to 24 months from the last relevant contact, unless objected to or deleted earlier<\/td>\n          <\/tr>\n          <tr>\n            <td>Client and contract data<\/td>\n            <td>Duration of the relationship + legal accounting\/tax periods (usually up to 7 years or the legally required period)<\/td>\n          <\/tr>\n          <tr>\n            <td>Student records \/ certificates<\/td>\n            <td>The time needed to accredit the training and handle validations; at least the applicable contractual\/legal period<\/td>\n          <\/tr>\n          <tr>\n            <td>Unsuccessful candidates<\/td>\n            <td>Up to 12 months from the end of the process, unless consent is given for a longer job pool period<\/td>\n          <\/tr>\n          <tr>\n            <td>Security logs<\/td>\n            <td>The time needed for investigation and security (usually up to 12 months, unless an incident is ongoing)<\/td>\n          <\/tr>\n          <tr>\n            <td>Non-essential cookies<\/td>\n            <td>According to the durations set out in the Cookie Policy and until consent is withdrawn<\/td>\n          <\/tr>\n        <\/tbody>\n      <\/table>\n    <\/div>\n    <p>Once the periods have elapsed, the data is deleted, anonymized or blocked, as appropriate.<\/p>\n\n    <h2 id=\"tr10\">10. Information security<\/h2>\n    <p>ITPMI applies reasonable technical and organizational measures proportionate to the risk, including: access control, passwords and profiles, encrypted channels where available (HTTPS), confidentiality agreements with staff and suppliers, backups according to the current infrastructure, and internal awareness. No measure guarantees absolute security.<\/p>\n\n    <h2 id=\"t11\">11. Data subject rights and procedure for exercising them<\/h2>\n    <p>Data subjects may exercise the rights recognized by the LOPDP, including:<\/p>\n    <ul>\n      <li>Access<\/li>\n      <li>Rectification and updating<\/li>\n      <li>Deletion<\/li>\n      <li>Objection<\/li>\n      <li>Annulment<\/li>\n      <li>Suspension<\/li>\n      <li>Portability (where applicable)<\/li>\n      <li>Not to be subject to decisions based solely on automated processing with legal or similarly significant effects, where applicable<\/li>\n    <\/ul>\n\n    <h3>11.1 How to exercise them<\/h3>\n    <ol>\n      <li>Send your request to <a href=\"mailto:contacto@itp.edu.ec\">contacto@itp.edu.ec<\/a> or through the <a href=\"https:\/\/itpmi.edu.ec\/en\/contacto\/\">contact form<\/a>, stating: full name, means of contact, the right you wish to exercise, a clear description of the request and, if possible, the context (course, date, company).<\/li>\n      <li>Provide a reasonable means of proving your identity (e.g. a copy of your ID card\/passport or equivalent validation). If you act as a representative, provide the document proving representation.<\/li>\n      <li>ITPMI may request additional information only when necessary to handle the request.<\/li>\n    <\/ol>\n\n    <h3>11.2 Response times<\/h3>\n    <p>ITPMI will respond within the periods established by the LOPDP and its Regulations. As an operational reference, we aim to reply within a maximum of <strong>15 days<\/strong> from receipt of the complete request, extendable in accordance with regulations when its complexity justifies it, with the data subject being informed.<\/p>\n\n    <h3>11.3 Complaints to the authority<\/h3>\n    <p>If you believe your rights have not been properly addressed, you may file a complaint with the <strong>Superintendency of Personal Data Protection (SPDP)<\/strong> of Ecuador, without prejudice to other legal actions.<\/p>\n\n    <h2 id=\"tr12\">12. Security breaches<\/h2>\n    <p>In the event of a security breach affecting personal data, ITPMI will assess the risk to the rights of data subjects and, where required by the LOPDP and its Regulations, will notify the SPDP and\/or the affected data subjects, documenting the incident and the corrective measures.<\/p>\n\n    <h2 id=\"tr13\">13. Staff, suppliers and confidentiality<\/h2>\n    <p>ITPMI staff with access to personal data are subject to duties of confidentiality and proper use of information. Suppliers and processors (including web development\/hosting and CRM tools) must process data in accordance with ITPMI's instructions, with security measures and, where applicable, confidentiality \/ non-disclosure agreements (NDA) and data protection clauses.<\/p>\n\n    <h2 id=\"tr14\">14. Minors<\/h2>\n    <p>ITPMI's services are mainly intended for professionals and companies. Processing the data of minors under 18 requires authorization from their legal representative, except for legal exceptions. If data from minors is detected without valid authorization, it will be deleted or blocked as soon as reasonably possible.<\/p>\n\n    <h2 id=\"tr15\">15. Automated decisions<\/h2>\n    <p>As a general rule, ITPMI does not make decisions based solely on automated processing that produce legal effects or significantly affect the data subject. If such systems are implemented in the future, this will be disclosed and the corresponding rights will be guaranteed.<\/p>\n\n    <h2 id=\"tr16\">16. Updates<\/h2>\n    <p>This policy may be updated due to legal, organizational or technological changes. The current version will be published on this page with its date of last update. Processing already disclosed will be progressively adjusted to the new version where applicable.<\/p>\n\n    <h2 id=\"tr17\">17.
